Jed Peterson Files Brief in Oregon Supreme Court in State v. Sagdal

Senior Associate Jed Peterson has filed the Petitioner’s Opening Brief on the Merits with the Oregon Supreme Court in State of Oregon v. Matthew Sagdal. The Supreme Court allowed review of two issues: whether the Oregon Constitution allows fewer than ten persons to reach a valid verdict in misdemeanor cases in circuit court, and whether the Confrontation Clause of the Sixth Amendment applies to a certificate of accuracy of alcohol breath testing equipment. The Court of Appeals published an opinion disagreeing with both arguments. State v. Sagdal, 258 Or App 890, 311 P3d 941 (2013). Oral argument is scheduled for September 15, 2014.
